1. Eligibility to Rent
- Renter must be 18 years of age or older.
- Valid government-issued photo identification is required.
- A valid credit card is required for payment and/or security authorization.
- Vertical Rentals reserves the right to refuse any rental at its discretion.
2. Rental Period & Charges
- Minimum rental period is one (1) day = 24 hours.
- Weekly rentals are seven (7) days; monthly rentals are twenty-eight (28) days.
- Rental periods begin when equipment is picked up or delivered and end when equipment is returned and accepted by Vertical Rentals.
- Late returns may incur additional daily charges.
- Equipment with hour meters may not exceed 8 operating hours per 24-hour period unless otherwise agreed.
3. Payment Terms
- Full payment is required in advance, unless otherwise approved in writing.
- All charges are subject to applicable taxes.

Renter authorizes Vertical Rentals to charge the credit card on file for:
- Rental fees
- Late returns
- Cleaning fees
- Damage or repair costs
- Replacement costs
- Collection or recovery fees
4. Delivery & Pickup
- Delivery and pickup services are available for an additional fee.
- Delivery times are estimates and not guaranteed.
- Renter must ensure a safe and accessible delivery location.
- Failed or rescheduled deliveries may result in additional charges.
5. Ownership of Equipment
All rented equipment remains the exclusive property of Vertical Rentals at all times.
Renter has no ownership, lien, or security interest in the equipment and may not sell, sublease, mortgage, or transfer it.
6. Equipment Inspection & Acceptance
- Renter acknowledges having the opportunity to inspect the equipment upon receipt.
- Equipment is accepted “as is” and in good working condition.
- Any issues must be reported immediately upon delivery or pickup.
Failure to report issues promptly constitutes acceptance of the equipment’s condition.
7. Authorized Use & Operator Requirements
Renter agrees that:
- Equipment shall only be used for its intended purpose.
- Equipment shall only be operated by trained, competent, and authorized operators.

Operators of aerial work platforms (AWPs), scissor lifts, or vertical mast lifts must hold:
- Valid Working at Heights Training (where required by law)
- Recognized AWP / MEWP operator training

Renter is solely responsible for ensuring compliance with:
- Manufacturer instructions
- Occupational Health & Safety regulations
- Provincial and federal laws
Vertical Rentals does not provide operator certification or training unless explicitly stated in writing.
8. Electric Equipment & Battery Care
For electric-powered equipment:
- Equipment must be charged when not in use.
- Batteries must not be allowed to remain in a deeply discharged state.
- Only approved chargers may be used.
- Improper charging, neglect, or damage to batteries is the responsibility of the Renter.
Damage to batteries caused by misuse, neglect, or improper charging is not considered normal wear and tear.
9. Maintenance & Care
- Renter shall keep the equipment in clean and safe condition.
- Renter may not perform repairs or modifications without written authorization.
- All damage beyond normal wear and tear is the responsibility of the Renter.
- Equipment returned excessively dirty may be subject to cleaning fees.
10. Prohibited Use
Equipment must not be used:
- In violation of any law or regulation
- In an unsafe or negligent manner
- Beyond rated capacity
- By unauthorized or untrained operators
- On unstable ground or surfaces unsuitable for the equipment
Vertical Rentals may immediately terminate the rental if misuse is observed or suspected.
11. Equipment Telematics & Monitoring
Equipment rented from Vertical Rentals may be equipped with telematics systems, including but not limited to systems that track:
- GPS location
- Operating hours
- Usage patterns
- Diagnostic and maintenance data
- Battery and charging status
- Alerts related to misuse, faults, or abnormal operation
The Renter acknowledges and agrees that:
- Telematics data may be collected during the rental period
- Such data is used for asset location, theft prevention, maintenance planning, safety, billing accuracy, and operational efficiency

Telematics data may be used to verify:
- Rental start and end times
- Equipment operating hours
- Proper use and care of the equipment
- Telematics data may be shared with law enforcement or insurers in the event of theft, loss, or damage
Renter shall not tamper with, disable, or interfere with any telematics, tracking, or monitoring devices. Any tampering or interference may result in immediate termination of the rental agreement, additional charges, and/or legal action.
12. Loss, Theft & Damage
- Renter is responsible for all loss, theft, or damage during the rental period.

Loss or theft must be reported immediately to:
- Vertical Rentals
- Local police (police report required)

Rental charges continue until:
- Equipment is returned, or
- Replacement value is paid in full
Replacement value is determined at current market replacement cost.
13. Liability & Indemnification
Renter assumes all risk related to equipment operation.
Renter agrees to indemnify and hold harmless Vertical Rentals from any claims, damages, injuries, losses, or legal actions arising from the rental or use of the equipment, including third-party claims.
Vertical Rentals is not responsible for:
- Job delays
- Lost profits
- Consequential or indirect damages
14. Insurance
Commercial renters may be required to provide:
- Proof of general liability insurance
- Proof of equipment coverage
- Certificates naming Vertical Rentals as additional insured (upon request)
15. Termination & Repossession
Vertical Rentals may terminate the rental and repossess equipment immediately if:
- Payment terms are violated
- Equipment is misused or endangered
- Renter becomes insolvent or bankrupt
- Equipment is subject to seizure or liens
Renter remains responsible for all outstanding amounts.
16. Late Fees, Interest & Collections
- Overdue balances may incur 2% monthly interest (24% annually).
- Accounts sent to collections may incur collection fees up to 20% of the outstanding balance.
- NSF or rejected payments may incur additional fees.
17. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada.
18. Acceptance of Terms
By booking, renting, accepting delivery, or using equipment from Vertical Rentals, the Renter acknowledges that they have read, understood, and agreed to these Terms & Conditions.
